Lors de l'audience de Référé de ce vendredi 8 novembre au TGI de VALENCE,
monsieur Matthieu Mangion le directeur de l'ASN, division de Lyon<br />
a été
incapable d'apporter une réponse à la Décision contraignante prise par l'ASN contre
la SA-EDF qui à ce jour ne peut fournir d'explication<br />
sur l'origine des fuites
radioactives actuelles constatées à la centrale nucléaire du Tricastin.<br />
Néanmoins Matthieu Mangion, même s'il n'a pas pu évidemment apporter une
réponse concernant sa propre Décision semble avoir convaincu <br />
le Président du
Tribunal par une plaidoirie persuasive sur les efforts que déploie l'ASN qui
met sous pression et fortes contraintes l'exploitant <br />
afin de mettre
un terme à la situation de dysfonctionnements actuels pour que la CN du
Tricastin retrouve la normalité dans les meilleurs délais.<br />

A l'issue des plaidoiries du Référé et face aux enjeux colossaux, pour l'organisation
il ne fait aucun doute qu'elle sera déboutée en première instance,<br />
cela
signifie de facto que la loi n'est pas respectée, mais aussi que <span style="background-color: #ffff00">nous sommes
entrés avec le nucléaire dans l'irrationnel où l'argent rend fou</span> car<br />
<strong>les lois
sur la sûreté nucléaire ne sont plus respectées.</strong> </font>

<font face="arial,helvetica,sans-serif" size="2">Les fuites radioactives à la centrale nucléaire du Tricastin
sont la conséquence de graves anomalies dont les origines ne sont pas
actuellement identifiées.<br />

Depuis début juillet 2013 le seuil d'alerte détecté d'activité
radioactive fixé à 100 Bq/l notamment pour le tritium a été dépassé. <br />

ont une activité moyenne de 500 Bq/L [Graphe radier sous réacteur n°3]</a> pour des masses volumiques affolantes de 150
m³/j <br />
à 850 m³/j d'eau contaminée pompée dans la nappe phréatique, puis rejetée dans l'exutoire non autorisé du Rhône, via son canal de Donzère. <br />

Ponctuellement l'activité radiative
détectée peut atteindre localement 6 000 Bq/L, etc ... Voire jusqu'à 160 000 Bq/L (sources SA-EDF Tricastin) !
<br />
EDF ne pouvant pas stocker et traiter en totalité de tels volumes, donc les
rejets dans le canal du Rhône deviennent maintenant massifs.<br />

L'État n'est pas au-dessus des lois, comme tous les citoyens elle se doit de
respecter ses décisions légales opposables, ceci quelles qu'en soit<br />
les conséquences.<br />
L'organisation Next-up a conscience des lourdes responsabilités qui pèsent sur
le juge judicaire, néanmoins le juge est chargé de faire appliquer <br />
les
décisions prises dans le cadre légal, c'est ce qui est ni plus ni moins demandé
pour la centrale nucléaire du Tricastin.<br />

A ce jour, il est constaté à la CN du Tricastin que la loi opposable TSN sur la sûreté nucléaire n'est
plus respectée c'est un acte criminel<br />
qui peut avoir des conséquences sur
le devenir de la France et de l'Europe.<br />

Face à une situation de sûreté nucléaire plus qu'inquiétante par rapport aux
anomalies et connaissant l'état exact de la centrale nucléaire<br />
du Tricastin au
28 10 2013, l'organisation environnementale a obligation de faire acte de responsabilité.<br />
En conséquence<span style="background-color: #ffff00"> l'organisation interjettera immédiatement Appel du jugement de
Référé auprès de la Cour d'Appel de Grenoble </span>ou engagera<br />
un Référé
Administratif dès qu'elle aura connaissance des attendus du jugement prévu en
principe pour ce mardi 12 novembre 2013.<br />

afin qu'il délivre une Ordonnance pour un
rapport d'étude indépendant portant sur l'état radiologique des eaux souterraines de la nappe phréatique <br />
actuellement pompée dans les zones géotechniques sous les réacteurs (le seul
rapport d'expertise et de laboratoire, hors frais de procédures<br />
a un coût de
plus de 12 000 euro).<br />
